Abstract
Texas, Florida, Louisiana, Mississippi, Oregon, and Arizona have enacted so-called property rights compensation statutes that entitle private property owners to compensation when local land use regulations diminish the value of their property, even though the property is not physically taken. The threshold amounts of value diminution, procedural issues, and other details of these statutes vary considerably from state to state. The question of value is critical in all of these statutes, and appraisers who keep abreast of developments in this area may find these statutes to be a valuable source of additional fee-generating opportunities.
